TERMS & CONDITIONS

The following conditions of entry apply to ALL ENTRANTS. Please read them carefully before entering the 2009 Ironman Western Australia :

1. The official online entry form must be completed by each intending competitor using his/her correct first name and family name and date of birth. Completion of the on line entry form and payment of the entry fee represents acceptance of these entry conditions.

2. Entries will be accepted from both Triathlon Australia (TA) Members and Non Members. The entry fee for Non-Members of TA includes the issue of a One Day Race Membership of TA. This membership provides cover for personal injury and public liability insurance only during the actual race day period of competition under terms and conditions as disclosed with such insurance policy held by TA.

3. International competitors - the entry fee for International competitors (bona fide non residents of Australia who cannot become full TA members) includes a Triathlon Australia One Day Race Membership which provides limited cover for the competitor for personal injury insurance only during the actual race day competition Race on terms and conditions as disclosed with such insurance policy held by TA. International competitors are advised to secure appropriate travel insurance from their home country.

4. All competitors must be 18 years of age or older on Race Day - 5 December 2009.

5. Competitors are required to produce proof of identification at Registration which must match the name under which the Competitor has registered online.

6. Age group and professional divisions will apply. All competitors are required to declare their status (age group or professional division). NB. Professional competitors who qualify for the 2010 Ford Ironman World Championship, Kona , Hawaii , must race in the professional division in Kona, whilst age group competitors who qualify may only race the World Championship, Hawaii in age divisions. Additionally, all competitors must abide by the World Triathlon Corporation policy in respect to Race Status / Category (Professional or Age Group), which states: "All contestants are required to declare their race status (Professional or Age Group) prior to any Ironman race. Additionally, the athlete must acknowledge he/she understands that if he/she races as a Professional athlete at any race during the calendar year (January 1 through December 31), he/she must qualify and earn a slot as a Professional to race in the Ford Ironman World Championship in that calendar year. USA Triathlon (USAT), the governing body for the sport of triathlon in the United States , sanctions the Ironman World Championship. Based on USAT rules, once an athlete competes as a Professional athlete anywhere in the world in the calendar year, the athlete cannot compete as an age grouper in that same calendar year in a USAT sanctioned event, including the Ford Ironman World Championship. Failure to disclose correct status shall be cause for disqualifying the athlete from the event and may result in a one-year suspension from USAT sanctioned events. During athlete registration at the Ironman World Championship race in Hawaii, all Professional athletes will be required to present a Professional card/licence, or letter from their National Federation, stating they are a Professional athlete. If the Professional card/licence or letter is not presented, the athlete will not be allowed to compete. An athlete that qualifies for the Ironman World Championship as an age group athlete, and is determined to be a Professional athlete during the calendar year of the event, will not be allowed to enter the Ironman World Championship, as he/she has not qualified for a professional slot".

7. A Professional division will apply for men and women. All Australian professional division competitors seeking entry will be required to hold and produce a separate and current professional division licence issued by Triathlon Australia . International professional division competitors will be required to produce a copy of a current (as at race day) professional division licence from their National Governing Body/Federation (NGB/NF) or provide evidence of professional division status from their NGB/NF should no licencing arrangement exist in their particular country.

8. There is equal prize money for Professional Male and Female athletes (US$50,000) paid down to tenth place, subject to Ironman rules which entail the 3rd to 10th place getter professional athletes needing to finish within 10% of the finish time of the 2nd place getter for both male and female. Due to drug testing results payment for prize money can take up to six weeks. Prize money winners will receive instructions at the Awards Function, and a letter detailing the method of invoicing IMG for the prize money - this is dependent upon the residential status of the competitor, and their Australian GST status. All non-resident prize money payments will be subject to the applicable withholding taxes. International professional competitors should be aware of the Australian Tax laws in respect to payment of prize money and withholding tax and the need for a work visa and the need to obtain an Australian Business Number and Tax File Number.

9. The following age categories apply to both men and women: 18-24; 25-29; 30-34; 35-39; 40-44; 45-49; 50-54; 55-59; 60-64; 65-69; 70-74; 75-79 and 80+ years. Age categories are based on age as at 31 December 2009.

10. All competitors must have completed at least a Sprint Distance (0.5km/20km/5km) triathlon and may be required to provide proof of such completion (results certificate) at Registration.

11. The organisers of Ironman Western Australia reserve the right to accept or reject any application at their discretion and also to issue special invitations.

12. In the event of a competitor notifying the event organiser that he or she wishes to withdraw from the Race prior to 5pm on Thursday 3 December 2009, the entry fee will be refunded less AUD$200 (including GST), being the non-refundable component of the entry fee. The total entry fee is non-refundable from 5pm on Thursday 3 December 2009 regardless of the reason for withdrawal from the Race.

13. The medical questionnaire section of the application must show full details of all Medical conditions, general health and surgical procedures within the previous twelve months. Medical consultation/clearance may be necessary from a medical practitioner prior to acceptance into Ironman Western Australia . In all cases, the final decision of medical consideration is at the discretion of Ironman Western Australia 's Medical Director.

14. Accepted applications are non-transferable.
    
15. Competitors qualifying initially or on Rolldown for the 2010 Ford Ironman World Championship, Kona , Hawaii are responsible for establishing qualification, claiming qualifier slot and completing all necessary entry requirements including payment of the World Championship entry fee at the Ironman Western Australia Race venue on the Sunday after Race Day - 6 December 2009.
    
16. There are thirty five (35) qualifying slots available at the 2009 Ironman Western Australia and these slots will be distributed across all race divisions in accordance with the World Triathlon Corporation policy and rules. Ironman Western Australia organisers reserve the right under these rules to withdraw a qualifying slot from any competitor accepting a slot where that slot may have been incorrectly distributed or offered for whatever reason.
    
17. World Championship qualifying slots are distributed across all race divisions in accordance with WTC policy and rules. Under these rules the Ironman Australia organisers reserve the right to withdraw a qualifying slot without prejudice from any competitor so awarded and accepting a slot where that slot may have been incorrectly distributed or offered incorrectly or wrongly for whatever reason.
